Terms of Engagement

Nifty Bear Web Design will build you a website based on your requirements. You are solely responsible for providing all the content on your website including imagery, text, links, etc. – unless otherwise specified in the quotation you receive.
By providing us with material and by signing off the project (making final payment or giving written word) – you are confirming that all material you provide us is legal, abides by UK law and doesn’t breach any copyright etc. (all material including content for website, print, graphics, merchandise, etc.). You confirm you have permission to use all content/resources and will take full responsibility should these be challenged by anyone externally. Nifty Bear Web Design has no liability whatsoever in regards to the content on your website that we build for you (and all additional materials/resources).
We shall not be liable for any of the following that may occur as a result of the project you are using our services for. In no way can we be held accountable if you: lose business, lose revenue, lose profit, lose opportunities, experience reputational damage and/or negative press, suffer any type of indirect or consequential loss, experience loss or damage caused by any inaccuracy, omission, delay, error (whether as a result of negligence or other cause) in the production of website, experience loss or damage to any content you provide us – whether due to negligence or otherwise.
If we decide content is not suitable (for example, pornographic material) or it breaches these terms, we can refuse to use it for any projects.
All items/materials/resources purchased by us as part of our working relationship will remain the property of Nifty Bear Web Design. These include, but are not limited to, domains, WordPress Themes, WordPress plugins, imagery, etc.
If you would like terminate an agreement or project, please email info@niftybear.co.uk. No refunds will be available and depending on the point of termination, you may be billed for the work undertaken by us (as specified in the quote). For example, we may have purchased a domain for X years and invested into the project (time and money) and therefore, you agree to pay any balance we consider due before the termination of this agreement or project is complete.
Any work required that falls outside the scope of a quote from Nifty Bear Web Design will be quoted for. You will have the choice whether you want to proceed with the new quoted work or not.
Nifty Bear does everything to ensure our quotes are accurate and provide you with good value. However, in the unlikely event that we have mis-quoted or misunderstood your requirements, we have the option to re-quote for the work, or decline it completely (even after the project has commenced).
Unforeseen additional costs may arise due to your requirements that were not included in the initial quote (e.g. fonts, stock imagery, etc.). If we need to source these during the project, the cost will be passed on to you and will be included in the final invoice.
Nifty Bear cannot be held accountable if your website is damaged in any way as a result of a cyber-attack, malware, or unscrupulous activity from external people/robots. If your site does suffer as a result of these, we can quote to take the best course of action but we cannot guarantee the site will return to the exact state it was at before being impacted. However, should you opt for the monthly updates option – your site will be in the best health, meaning security breaches are very unlikely. The site will also be backed up with this added service, so old backups can be used to restore the site to previous versions.
We cannot be held accountable for any website downtime or any impact this may cause for your business. It is your responsibility to frequently check the website to ensure its live and appears as it did when signed off.
Occasionally, installing updates (WordPress, plugins) can negatively impact a websites design as certain features may become corrupt or no longer supported by website theme. If such an incident occurs, we cannot be held accountable but would be willing to quote to repair/restore/replace. You will need to advise us accordingly.
If your website is performing slowly, it may require a hosting upgrade. If this is the case, we will quote accordingly. We always try and ensure websites use the most cost-effective solution that provides excellent performance.
We occasionally use external partners to help with projects (including web design, graphic design and maintenance). All data is kept secure, and only shared with trusted partners of Nifty Bear Web Design. By giving the project the green light, you agree to this.
